Trump administration withholds 100K Kavanaugh pages

With midterm elections two months away, Judge Brett Kavanaugh is set to appear this week for his Supreme Court confirmation hearing.

The White House chose to hide these documents, citing executive privilege as its rationale, said William Burck, the head of a team of lawyers who reviewed some 664,000 pages of Kavanaugh-related documents housed in Bush's presidential library.

The records are from Kavanaugh's time working as a lawyer for former President George W. Bush's administration. Burck explained that, in all, he received just under 664,000 pages of documents and that Bush had directed him to "proceed expeditiously" and "err as much as appropriate on the side of transparency and disclosure".

"It's not normal because we are not able to see 100,000 documents because the administration has said we can't see them, exerting their executive power", Klobuchar said on NBC's "Meet the Press". The documents in question were part of the judge's time serving the Bush White House and the GOP says the documents are protected under presidential privilege.

To prepare for the hearing, Kavanaugh has participated in private rehearsals coordinated by the White House Counsel's Office, which have included more than a dozen participants - government lawyers, conservative academics, some of his former law clerks and even several senators.

The major portion of the documents withheld for privilege "reflect deliberations and candid advice concerning the selection and nomination of judicial candidates, the confidentiality of which is critical to any president's ability to carry out this core constitutional executive function".

"If Brett Kavanaugh is appointed to the Supreme Court, he will undoubtedly be the deciding vote to gut Roe v. Wade and criminalize abortion, bringing us back to a dark chapter in this country's history that forced women into unsafe, illegal abortion", said Karin Roland, Chief Campaigns Officer of UltraViolet. "The issue now is what are Democrats going to do about it?" But the privilege was never formally asserted.

Senate Minority Leader Chuck Schumer (D-N.Y.) blasted the Trump administration's decision to withhold some of Kavanaugh's records, referring to it as a "Friday night document massacre". What are they trying so desperately to hide?'

Presidential documents would typically be reviewed by the National Archives.

In Kavanaugh's case, Republicans are circumventing the normal vetting process for Supreme Court nominees by in order to have him confirmed by October 1, the start of the court's new term.

Burck noted that so far, the Archives has agreed with the "vast majority" of how Burck's team has categorized Kavanaugh's documents.
