Trump vows to end birthright citizenship in challenge to 14th Amendment

Trump also asserted that birthright citizenship "is not covered by the 14th Amendment because of the words 'subject to the jurisdiction thereof'".

Trump said Republican Congress without Paul Ryan as Speaker would focus more on stopping illegal immigration. Trump floated the idea of changing that in a TV interview with Axios, excerpts of which were made public on Tuesday.

The Supreme Court has upheld the principle of birthright citizenship for more than a century, it said.

Trump stated his disapproval of the current system that allows children born to noncitizen parents while on American soil to be granted citizenship.

Trump said he had spoken to legal counsel about it and that the change is in the works. "We didn't like it when Obama tried changing immigration laws via executive action", Ryan added.

"It was always told to me that you needed a constitutional amendment, one amendment".

Birthright citizenship is the practice of granting full citizenship to anyone born in the United States, including those born to parents who are in the country illegally, on a temporary visa, or as tourists.

And while Trump sounded committed to the effort, at this point we don't know whether such an executive order even exists, let alone the fine details. "There is a debate among legal scholars about whether that right extends to the children of illegal immigrants".

Mr. Trump shifted his proposed plans to dismantle birthright citizenship, after saying Tuesday that he meant to end the 150-year-old practice established by the 14th Amendment with an executive order.

Some legal scholars argue that the phrase "and subject to the jurisdiction thereof" seems to give the government some leeway to restrict the right, just as other constitutional principles can be limited.

The Supreme Court has not ruled specifically on the issue of whether illegal immigrants can be denied birthright citizenship. I think there would nearly certainly be a lawsuit and the courts will decide.
