But before she even addresses MPs her Government will come in for intense criticism over claims it is in contempt of Parliament by refusing to publish the full legal guidance given to ministers about the Withdrawal Agreement and Political Declaration negotiated with the European Union.

MPs from across Parliament have argued that they are required to release the full advice - including Mr Cox's legal opinion - following a binding vote last month.

The government, in line with usual practice, has resisted publishing its full legal advice on grounds of confidentiality.

The main opposition Labour Party says it will seek a vote of no confidence in the government if May loses the vote.

May is battling to persuade lawmakers to support the divorce agreement between Britain and the European Union in a December 11 vote.

The backstop is intended as a temporary measure, but pro-Brexit lawmakers say it could leave Britain tied to the European Union indefinitely and unable to strike new trade deals around the world.

Europe's top court said on Tuesday it would decide "quickly" whether Britain can unilaterally reverse its decision to leave the European Union, a ruling supporters of membership hope could lead to a second referendum and ultimately stop Brexit.

The Secretary of State for Scotland David Mundell urged MPs to back the Prime Minister and vote for the Brexit deal.

"This would be a collision course between the government and Parliament", he told Sky News.

With around 100 Conservative MPs saying they could vote against the deal, the odds are stacked against the government.

The Prime Minister faces widespread opposition from MPs across the Commons - including both the Leave and Remain wings of her own party - ahead of the vote.

May adamantly rejected Sunday the idea of EFTA membership as an alternative if her deal fails to get sufficient parliamentary backing.

Mr Robbins said that her deal risked "security cooperation with the EU", in his letter from October 19 which has been seen by the Telegraph.

Cox said he would have preferred to have seen a unilateral right of termination in the Northern Ireland backstop arrangement, but added he supported May's deal because he did not believe Britain would be willingly trapped in it permanently.
