Judge orders North Korea to pay $500 million to family of Otto Warmbier: report

North Korea said Warmbier contracted botulism while in detention, but USA doctors found no trace of the illness.

In early June 2017, Mr Warmbier's parents were informed he was in a coma and had been in that condition for an entire year.

North Korea has denied that Warmbier was tortured and has said he contracted botulism in custody, though medical experts said there was no evidence of that.

It is somewhat inevitable that judge Howell's fiery words are likely to miss their target alongside the court's default judgment, considering the fact that North Korea has very few, if any, assets which the U.S. government could seize in order to enforce the payments, and that the Korean's themselves are rather unlikely to show up in court for an alternative punishment. According to The Hill, Howell found Warmbier's estate to be entitled to $21 million in compensatory damages and $150 million in punitive damages, in addition to Fred and Cindy Warmbier, Otto's parents, each being entitled to $15 million in compensatory damages and $150 million in punitive damages.

Howell awarded $15 million to each of Warmbier's parents for the emotional anguish of living through their son's disappearance, detention and death. Howell declined to award the more than $1 billion in punitive damages requested by the family, calling it "out-of-line". He was imprisoned by the North Korean government and suffered severe brain damage, but there were no signs of physical trauma.

"Otto excelled at all that he set out to do in his young life", she wrote, and his nature "makes highly plausible that this success would have continued". But, he said, "the award will be hard if not impossible to enforce". On the basis of a USA law that allows lawsuits against foreign governments for actions in which there is no diplomatic immunity.

But North Korea is seeking to end economic sanctions imposed over its nuclear program. "As a family, mother, father, sister and brother, we would like to thank all those who knew and loved Otto, and for all those who supported us and our mission to hold Kim liable for his actions", the statement reads.

"North Korea is not going to pay anything voluntarily" in response to the judgment, "but this is not a happy outcome for the North Korean state".
